Medical malpractice is an act or omission by a health care provider which deviates from accepted standards of practice in the medical community and which causes injury to the patient. Simply put, medical malpractice is professional negligence (by a healthcare provider) that causes an injury.
Health care providers include medical doctors, nurses, hospitals, chiropractors, therapists, dentists, nursing homes and anyone else who have a duty to treat a patient.
When the health care provider's error results in an injury to a patient, that patient can pursue a medical malpractice claim. Some examples of medical malpractice are:
- Birth injuries
- Failure to diagnose a problem
- Nursing home abuse
- Prescribing the wrong medicine
- Failure to provide proper treatment
- Mistakes in surgery
